I assume the fact that they're going to court means they've denied it being theirs. Otherwise court wouldn't be required.

Uhh, court would be required to prove them not guilty. The police would give the evidence, take a statement, and then it would be up to a specific person on the police force to decide as to whether it goes to court or whether they get let off. Since it's CP, which is a pretty serious crime, they'd take them to court. They wouldn't bring them in for questioning until they have enough evidence to take them to court.

Dude I'm 16. But if he actually took it, I'd recommend you go for an out of court settlement to save legal fees and time. Either money, to the sum of how much the gummy bears cost, or a 20 minute session between you and his ass.
