I've been wondering about this for a while now. I have read up quite a bit on the 3ds and its glassless tech. From what I've come to understand, the slider works on the software, not the hardware end, i.e. cubic ninja's force disable. What this means, is that regardless of the position of the slider, the image is still in 3d, and using the 3d tech, only the 2 images for each eye match, so you don't see it. This makes me wonder, if disabling it for small children really helps anything...? I think Nintendo was hoping nobody would look that deep into it. I'm interested what others think, and if anyone can disprove this.
