I found this guy on eBay selling PSP freeware. See his last sale:

Games he's selling: PacMan v? PSPChess v0.8 Tetris (no pic) PSP Solitaire PSP Rick Dangerous Bejeweled / Polygon Tic Tac Toe Dual Tetris Snake Devs, have you been solicited and given permission for anyone to profit from your work? He could be using the same excuse that people give for selling MMORPG online currancy for real money..."You are buying my time and effort in earning these, everything you buy is still property of etc..." Selling the actual currancy will violate the end user agreement so I guess this is sort of a loop hole. Dunno if hes using the same excuse, but either way, its gay.

Yo for someone to get back at this guy just make an ebay sale page in the same topic as his. What i mean is you can create a ebay action and when people go to click on it the page tells them "This is not a real say the information on this page is free and the links to the sites are free". On that page you can just link them right to this website or the form with instructions on how to get what that guys is selling for free.
Someone should really do this because that guy selling information that is already avaible to the public for no fee is not right. |

pisses me off how people get away with stuff like this when i have made several attempts to auction my WOW and FFXI accounts and ebay always removes them. I even put up disclaimers! This guy has some balls.

Here's the reply I got from the jerk: "anyway, what is your problem. i did post that this only work with version 1.50. and anyway im just helping people that dont know anything about what psp can do, and they do like it--NO complain or such thing. ? email me."
He's hiding behind: eBay Member: mareszah_17 <member@ebay.com> I've already put the word out to the devs (they should get on board shortly). I've also spoken to his latest purchaser (with plans to contact all of the ones he's sold to in the last couple of months). With some of the comments, pos and neg, there's little doubt he's selling the software. - Squidly1 |

So if you were to sell a 1.5 psp, is it safe to assume you couldn't leave your roms on the memory stick and sell them too?
I was lying awake last night wondering about that. |

My hope is that he'll take the hint, before he pisses someone off enough to get sued. But hey, having him sued is cool by me.
Oh, I posted the same information on PS2Dev and got only one response (really surprising since I thought I might catch the game devs there): "Great work caped crusader. And I wonder if the homebrew authors bothered to contact Midway or Atari about the use of trademarks." - to which I privately replied (since the discussion has been locked before I could publically comment) - I think you might have missed the totality of my argument. I’m assuming the “caped crusader” comment was not just put out there to enflame. While I agree that those who have converted previously published games over to the PSP (from your mentioned Midway and Atari) shouldn't get a dime, I do dispute people who take programs that someone coded from scratch (which have never been marketed, developed or published by anyone else) and sell them without thinking about that coder (sharing profits). Or even asking permission to do so... However, that doesn't stop me from buying a beer at the pub for the code converter - as a fellow coder that's still a good trick. The homebrewers I know of, so far, aren't asking for or making a dime. This eBay guy is. While I've never had any of my code sold out from under me, I have had situations where my ideas were snagged up by another - who later was recognized for "thinking outside the box" and received compensation for the idea. This is the same situation. I wanted to alert the devs to this situation in order to help them protect what they have worked on. After all, the average homebrewer doesn't have a trademark or copyright on his/her work to go after this guy with. However, Atari and Midway do - if they wanted to... - Squidly1 |
