Emulators are legal because they serve developmental purposes. Roms are for most cases illegal regardless. If you have the game, the game is non-functioning, and you made the ROM yourself, then it MIGHT be legal. The DCMA is less than clear.

People make such a fuss... Roms/Emulators aren't illegal if you do own the actual system/game. I personally think anything N64/PSX and below should be open to emulate freely, seeing how the companies don't actually make money off them anymore. :/
Maybe that was Nintendo's idea with the whole Revolution thing? AH HA! >.>;

Not true... They're illegal regardless...
Zitat von gamehunter101
Now, like it was stated, you chances of getting caught are practically zero (nobody's really looking for people that are downloading ROM's... They're mostly just looking for people that are distributing them)...
The only way owning roms is legal, is if you ripped them from your personal cartridge... If you didn't rip it, it's not legal...[B]Girl, just call me the gamecock, because when you beat it on hard, you get the special ending.
They call her a ho, and you hope to god it was true...

Yeah noone gets in trouble for roms, last person i heard of getting arrested was the dude that dumped the Marvel vs capcom chaos rom [I think it was that game]
He got lock up for it but like someone else said he was distributing it so thats why he went down.
Last person i heard about getting done for films was the dude that robbed the unfinished version of 'The incredible hulk'. Im sure he got 3 years hahaah nevermind it was pathetic as well all the cgi was out of proportion.
Anyways ROMS OWN!!!!!!!!!!!!

Still not quite correct... but I just get fed up with repeating it... They're illegal regardless... UNLESS you have gained permission to backup OR are the copyright owner (or it states you are allowed to make a backup in the licence agreement)... just because you own the Original it isnt your AUTOMATIC RIGHT to backup something UNLESS as I stated you have gained permission to backup OR are the copyright owner!!! (or it states you are allowed to make a backup in the licence agreement)

Actually, it depends on the country you currently live in.
You have to obey the laws of the country you live in, NOT the "laws of the United States of America" (i.e. DMCA) unless you actually LIVE in the United States of America, in which case U.S> law would apply to you.
Now, if you live in certain African countries that have little-to-non-existant copyright or infringement laws (Lagos comes to mind...), then you can download all the ROMs you want and play them to your heart's content. However, you HAVE to be living there.
So the legality of the matter rests entirely on the laws of the country you live in.
I suggest you go research your country's laws.
Remember, if you live in the U.S., then under current DMCA law AND the new copyright extension act, all ROMs are illegal. Even ripped from the ones you own, since ripping them violates the most current wording and definition of the U.S. DMCA.
And another note to remember: some countries have laws making some "shrinkwrap" EULAs for software ILLEGAL if they contradict any current law(s) of that country.Geändert von iball® (11-01-2005 um 05:53 AM Uhr)
