    the smb3 hack that gives like 7or 8 new worlds after the original 8, I saw it on one site but they had a 100 post min. to download. Is it worth it?

    Yea, basically all roms aren't legal, I'm sure there's technicalities but... that's why we don't link to them on this site. I think I remember another thread, where people just posted the filename;) and description of what the hacked rom was, and others could search in google and get it ;)

    If it wasn't legal would you stop playing it, immediately wipe it and all other roms from your mem stick and turn yourself into the proper authorities?

    Ive looked into these technicalitys far to much, and I have found out one thing.
    IF the federal agents are going to come knock on your door because you downloaded a
    game that is not, and has not, been sold in years.... I doubt they would go through
    your shelves and drawers to see if you own the games.......

    If the factor is guilt.... If you own the cartdrige, it is NOT illigal (it IS legal) to own the
    rom image.

    Guilt? I've been through Atari, intellivision, NES, Gameboy, SNES, Sega Gen, N64, PS1, PS2, XBoX, and PSP. Not to mention computer games and god knows how many quarters at the arcade....and than rentals. I belive that I made my contribution to the video game industry, and if I choose to play dark cavern on my psp, than gosh darn't i'm going to play it. :)

    some roms the legal owner of the game well the compony dies and it becomes legal for all to download some rom sites have just legal roms that you dont need to own the origanal file

    its legal to own an emulator if u own the console, its legal to own roms if u own the game, but it is illegal to download a hacked rom that has not been officially released by the developers/releasers!!!!!!!

    There is such thing called an ips patch which is what you use to put a hack onto a ROM. There is alot at Zophar.net.

    The only roms that are actually legal need to have all of the following conditons:
    1. You own the original game
    2. Your original cartridge is broken
    3. You wrote the rom up your self right before the game broke

    So, actually hardly any if any are legal...

    PSPunk, don't forget that ROMs are not always commercial games. People actually make "homebrew" games in ROM form for use with emulators. Also, titles sometimes become public-domain if the copyright holder goes out of business and doesn't transfer the copyrights to another entity.

    All of the ROMs found on zophar or pdroms are examples of the above.

    Taking a look at the true Legal aspects in the digital millienium copyright act, under the fair use clause. You are allowed to have a rom of ONLY one that you have dumped (and the equipment is usually expensive), but if it is Nintendo "Any Kind" Rom you are not allowed to have an Emulator for it because the Nintendo "Type" Emulators have been patented under the Patent Office for the Revolution lol. However, I do think you are allowed to have 1 backup, I'm not so certain about you original cartridge having to be destroyed.

    Nintendo is a real pain when it comes to this issue. They've been the most adamant company I've seen in shutting down ROM sites and getting their games off ROM sites. I've only found one or two sites that have Nintendo ROMs (I'm talking about Mario, Zelda, Metroid, etc...not about NES ROMs in general), and I'm surprised they're not shut down yet. But IMO, as long as the publisher holds the copyright, commercial ROMs are illegal (and hacked ROMs are illegal in so many other ways).

    There is a gray area about it that conflicts with one's own rights and what a company prohibits you from doing. For example, on the back of most instruction booklets for some nintendo platforms (I think I read it in either a SNES or N64 manual but it's also on GameCube manuals), Nintendo specifically prohibits you from making any kind of backup from your game... Like I said, Nintendo is REALLY adamant about this issue and take it very seriously more-so than any other game company I've seen. Ah, found it in my Animal Crossing GameCube game, here's the notice just FYI:

    "WARNING:Copying of any Nintendo game is illegal and strictly prohibited by domestic and international intellectual property laws. 'Back-up' or 'archival' copies are not authorized and are not necessary to protect your software."

    The next paragraph goes on to talk about how copying devices are not authorized for use with any Nintendo game. Then Nintendo says:

    "The contents of this notice do not interefere with your statutory rights."

    So there is an illustration of the gray area of copying video games.

    Under French law (and some other places) you have the right to make a back-up copy of any software you leagally own.So .... Anyways i think it is not ethicly wrong to play a game that you legally own.I own chrono triger (among others) and i play it on my psp coz my snes is dead (and i think the cartidge is also dead).
