Downloading a ROM is illegal, no matter what. The only legal rom you can have is if you rip it yourself for archival purposes, but there haven't been many clarifications or adjustments to the law since ROMs became an issue

Yes but only for you. You have the game, so it is perferctly legal for you to dl the game in rom form.

Altough, I would hasten to add; It's gonna be quite hard for anyone to ever prove that you've downloaded it as opposed to ripped it if you own the original.

k these legal questions have to stop because for the most part were useing us laws if you don't live in the us then us laws don't apply it's your country's legal system not the us's so these questions have to vuking stop because there is a small possibility that it is legal in your country or hombrew may be illegal in some country's(small possibility) even then it's not like the cops are ganna bust into your house and search for any roms that you have on your comp(if it is illegal to have them in your country)

He physically didn't make the copy off of media that he owned, therefore its illegal (since its a backup of someone else's game).

When you buy a DVD, CD, game or anything like that, you don't own that actual game. You are buying 2 things

1) The media that the files are stored on

2) The right to use said media

The actual files are still copyrighted by their respective owners. Its legal for you to make backups of media you own (CD to mp3 player, CD to CD are some examples).

Backups are only supposed to be used if the original media no longer can be used (disc scratched or broke), since that's the point of a backup.

Roms are a gray area because there really isn't any reason to backup a cartridge console game (a case can be made for disc based games).
