Hi All

I was really p*$$*d at being told by a major UK games store that I wasn't going to get my 360 and they wanted me to collect my deposit. I refused and contacted my local trading standards and got the following advice.

As I specified before paying the deposit I would only place my pre-order if they were sure I would receive one before christmas that constituted a verbal contract and part of the condition of sale.

I did not have to collect my deposit and could wait for them to supply the package that I had ordered as failure for them to provide me with the package of goods was a breach of contract.

Now the really interesting bit!!! :icon_razz

If they cannot supply me and I can source the same package but at a higher price I am entitled to pursue a claim against the company for "loss of bargain" which basically means they have to pay me the difference between their price and the price I pay.

I called the retailer back at 5pm yesterday and informed them of this and that I had found a source that could supply me with the same package but at an increased cost of £180 (Yeah £449.99 for the premium pack, don't you just love rip off catalogues) and with the web url for the item and the store manager said he would have to speak to his superiors.

Hey presto, just had a call from the store manager to say that they will be able to supply me from their second delivery around the 5th dec.

Ok not a launch day but at least I'll have it in time for christmas

Don't take no crap from these retailers flex your muscle and find your rights!!

The best way to do it!! People are so unaware of there rights in this country, trading standards are always willing to at least give you some advice!!!

Score one for proper use of the U.K. laws! Now go out and wreak great havoc at your local Tesco!

It depends on the Law. Like in Mi the law says you have to sell something my the price on the label. One time i found an external HDD marked 50 bucks cheeper and at chechout they wanted to mark it back to msrp and i told them about the law and they sold it.
